BSQ Pre-Charge Representations Result in Discontinuance of Police Investigation
In two recent cases where BSQ acted for separate privately funded clients, BSQ have successfully persuaded the authorities to discontinue pending criminal investigations into serious allegations of sexual misconduct.
Both of BSQ‘s clients were business professionals – working in finance and real estate in the City of London respectively. Both vigorously denied the allegations of sexual misconduct made against them.
BSQ partner Roger Sahota was instructed to act for both clients during the investigation stage. Detailed pre-charge written submissions were filed with the police/CPS and considered at the stage a charging decision fell to be made once the police investigation had been completed. After a full review, the authorities in both cases decided not to initiate a prosecution against our clients.
In our submissions, BSQ argued that deficiencies in the evidence meant that there was no realistic prospect of conviction and the first limb of the test set out in the code for crown prosecutors was not met.
