BSQ Indecent Images Blog – Prosecution Discontinued against BSQ Client
Another BSQ client has been acquitted of indecent images charges. Following a three year investigation and prosecution BSQ successfully persuaded the CPS to review the evidence against their client C. After considering BSQ’s representations and an independent defence experts report a decision was taken to discontinue to the case against C.
The case against C is an interesting case study in how prosecutors and police investigators often fail to properly apply the correct law relating to indecent images cases. BSQ had argued that the police had not properly considered exculpatory evidence obtained by BSQ suggesting that out client was not responsible for accessing illegal material found on various devices attributed to him. Regrettably the decision to discontinue was taken only once the case was before the Court and a trial date was imminent.
